Introduction

Fictive Pursuits is committed to respecting the intellectual property rights of others and expects its users to do the same. We have adopted this Digital Millennium Copyright Act (DMCA) policy to provide a clear procedure for reporting copyright infringement and for responding to such reports appropriately.

Reporting Copyright Infringement

If you believe that material on our platform infringes upon your copyright, please submit a notification of claimed infringement to our designated agent:

Your notification must include the following information:

  1. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  2. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material. Please provide a URL to the allegedly infringing content.
  3. Information reasonably sufficient to permit us to contact you, such as an address and email address.
  4. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. Provide your full legal name and your electronic or physical signature.

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability.

Counter Notification

If you believe that material you posted on our platform was removed or access to it was disabled by mistake or misidentification, you may submit a counter notification to our designated agent. Your counter notification must include the following information:

  1. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  2. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  3. Your name, address, and email address, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or if your address is outside of the United States, for any judicial district in which the service provider may be found, and that you will accept service of process from the person who provided notification of the alleged infringement.
  4. Your physical or electronic signature.

Repeat Infringers

Fictive Pursuits reserves the right to terminate accounts and access to the platform of users who repeatedly infringe upon the copyrights of others.

Changes to Policy

Fictive Pursuits may revise this DMCA policy from time to time. Any changes will be posted on this page.
